I don't think it's actually a faction server. I think like minded people just band together faction style. Someone correct me if I'm wrong.

You are correct, Factions are unofficial and done entirely by players, with no protection from staff or the server.

to start a faction, you literally say in chat "who wanna join my town" the voila, becareful your choices though. otherwise its done. i can literally make my own faction in 2 seconds

Starting a faction is easy. However keeping it both alive but still growing is hard.

i did it by choosing a name and banner and invited trust worthy players to join me
